Harz AG’s General Terms and Conditions for the HarzCard


(Effective January 1, 2024)

The following terms and conditions are deemed agreed upon for the issuance and use of the HarzCard, hereinafter referred to as “HC”:

1. Basis of the Agreement: The purchase of the HC does not constitute the conclusion of any contracts with service providers listed in the HarzCard travel guide. Service providers are the companies that offer the services listed in the HarzCard travel guide. The cardholder concludes the respective contract with the service provider directly, either prior to or upon utilizing the listed service. In particular, Harz AG is not a tour operator but merely facilitates the use of the services available with the HC. For a one-time flat fee, the service providers offer the cardholder the use of the services listed in the current HarzCard guidebook under the conditions specified therein during the HC’s validity period. Subject to printing errors, changes, and omissions.

2. Scope of Services: Service providers have agreed to make the services designated as HC services available to HC holders during the season, during normal business hours and in accordance with the General Terms and Conditions of Carriage or Business, without restriction and in full. However, the operating hours of some service providers do not cover the entire validity period of the HC, primarily due to weather and seasonal conditions. Restrictions may also result from individual closures. The scope of HC services and how to obtain them are detailed in the HarzCard travel guide. The scope of services may be limited depending on the card type. Discounted services are provided subject to availability. Claims by the cardholder arising from the failure of individual service providers to provide services cannot be asserted against Harz AG. Harz AG assumes no liability for the services provided by the service providers. Furthermore, Harz AG assumes no liability whatsoever for damages attributable to force majeure, other natural disruptions, or external influences of any kind that are beyond the control of Harz AG. This applies in particular to all measures related to a pandemic. The information on the service providers’ websites must be strictly observed. Tickets may not be exchanged or returned. Harz AG reserves the right to expand or restrict the scope of services covered by the ticket at any time. No refunds will be issued in the event of loss of the ticket or the closure of individual facilities.

3. Validity: The season (validity period) during which the service providers’ services may be used begins on January 1 and ends on December 31 of a calendar year. The validity period depends on the selected card type (Option One: 4 days of your choice within the calendar year; Option Two: 48 hours). The validity period for Option One begins on the day of first use and ends no later than 12:00 a.m. on December 31 of the respective year. The validity period for Option Two begins with the first use and ends after 47 hours, 59 minutes, and 59 seconds. Unused days or hours of use cannot be carried over to the following validity period.

4. Prices: The prices listed in the HarzCard travel guide apply to the Adult HC and the Children’s HC.

5. Children’s and Bambino Cards: The Children’s HC is valid for children aged 5–14. When purchasing an adult ticket, children up to and including age 4 receive a free Bambino HC.

6. Use: To obtain the card benefits, the cardholder must present their valid HC, which will be checked for validity by the service provider using a reader (technical system) prior to the conclusion of each individual contract.

7. Misuse: In the event of misuse or suspected misuse, the service providers are entitled and obligated to retain the HC without replacement. The cardholder is liable for misuse of the HC by third parties. In the event of theft or loss, the cardholder is obligated to report the incident by calling +49 (0) 3943 935800; however, there is no entitlement to the issuance of a new HC free of charge.

8. Transferability: The card is not transferable without the express written consent of Harz AG. The rights arising from the card may not be assigned to third parties without the consent of Harz AG.

9. Changes: Harz AG is entitled to amend the General Terms and Conditions at any time. The user accepts the new terms and conditions by continuing to use the card.

10. Place of Performance: The place of performance is Wernigerode, the registered office of Harz AG.
